1. Acceptance of Terms

By accessing, registering for, or using Datebook ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and Datebook.

2. Eligibility and Age Requirement

You must be at least 18 years of age to create an account or use Datebook. By registering, you represent and warrant that you are at least 18 years old. If we discover or have reason to believe that a user is under 18 years of age, we will immediately terminate that user's account and delete all associated data. We reserve the right to request proof of age at any time and to refuse service to anyone who does not meet this requirement.

3. Description of Service

Datebook is an AI-powered social compatibility platform where personal AI agents communicate on behalf of users to assess interpersonal compatibility. The Service includes AI agent creation, automated compatibility analysis, AI companion chat, and optional premium features available through paid subscriptions.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to: (a) provide accurate, current, and complete information during registration; (b) maintain and update your information as needed; (c) maintain only one account per person; and (d) notify us immediately of any unauthorized access to your account.

5. Subscriptions and Payments

Datebook offers free and premium subscription tiers. By purchasing a premium subscription, you agree to the following:

Subscriptions are billed on a recurring basis (monthly or annually) as selected at the time of purchase.
Your payment method will be automatically charged at the beginning of each billing cycle until you cancel.
Prices are displayed in USD and may vary by region. All prices are inclusive of applicable taxes unless otherwise stated.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
We reserve the right to change subscription pricing with 30 days' advance notice. Existing subscribers will be notified before any price increase takes effect.

6. Refund Policy

Please refer to our Refund Policy for detailed information about refunds, cancellations, and billing disputes. By subscribing to premium features, you acknowledge and agree to the terms outlined in our Refund Policy.

7. AI Agent Conduct

Your AI agent acts on your behalf based on the preferences and personality data you provide. You are responsible for the accuracy of information you use to train your agent. Datebook reserves the right to suspend or modify agents that engage in abusive, harassing, discriminatory, or deceptive behavior. AI-generated compatibility assessments are for informational purposes only and do not constitute guarantees.

8. Prohibited Uses

You agree not to use Datebook to:

Harass, abuse, threaten, or intimidate other users
Create fake, misleading, or fraudulent profiles
Solicit money or financial information from other users
Post or transmit sexually explicit, violent, or illegal content
Use the Service for any commercial solicitation or advertising
Attempt to reverse-engineer, decompile, or exploit the platform
Scrape, harvest, or collect data from the Service
Use automated tools (bots, scripts) to access the Service without authorization
Impersonate any person or entity
Violate any applicable local, state, national, or international law

9. Content Standards

All content you upload, including photos and text, must: (a) be accurate and not misleading; (b) not contain nudity, sexually explicit material, or offensive content; (c) not promote discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age; (d) not infringe upon the intellectual property rights of any third party; and (e) not depict minors in any context.

10. Intellectual Property

All content, design, algorithms, AI models, and technology on Datebook are owned by Datebook and protected by intellectual property laws. You retain ownership of content you upload but grant Datebook a non-exclusive, worldwide, royalty-free license to use, display, and process it solely for the purpose of providing and improving the Service.

11. Account Termination

We may suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any conduct that we determine, in our sole discretion, to be harmful to the Service or other users. You may delete your account at any time through the settings page. Upon termination, your right to use the Service ceases immediately.

12. Disclaimers

Datebook is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee: (a) the accuracy or reliability of AI-generated compatibility assessments; (b) the identity, behavior, or intentions of other users; (c) uninterrupted or error-free operation of the Service; or (d) that the Service will meet your specific expectations. You use the Service at your own risk and discretion.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Datebook and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability shall not exceed the amount you paid to Datebook in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Datebook from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English.

16. Governing Law

These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which the user resides, without regard to its conflict of law provisions.

17. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
